CancelMySolar.ai is not a law firm and does not give legal advice. Using this Site or submitting an assessment does not create an attorney-client relationship with us or with anyone else. These Terms contain an arbitration agreement and class action waiver in section 12, which affect how disputes are resolved; you may opt out within 30 days as explained there.
1. Agreement to these Terms
These Terms of Service (the "Terms") are a binding agreement between you and OLP.com Inc., doing business as CancelMySolar.ai ("we," "us," "our"), 1123 North Bronough Street, Tallahassee, FL 32303, governing your use of cancelmysolar.ai and related pages, forms, calls, texts and emails (together, the "Service"). By using the Service, submitting a form, or asking us to contact you, you accept these Terms and our Privacy Policy. If you do not agree, do not use the Service.
2. What the Service is, and is not
The Service provides (a) general educational information about consumer rights relating to residential solar contracts, (b) a free questionnaire (the "assessment") followed by a free, informal consultation with a member of our team or our intake partner about the information you provided (the "consultation"), and (c) an introduction to an independent intake company (our "intake partner") that reviews solar contract inquiries and, where appropriate, refers them to an independent attorney or law firm. The assessment is reviewed by a person, not scored by software.
The Service is not legal advice, legal representation, or a legal opinion. The consultation is an informational discussion based on the information you provide; it is not a legal analysis of your contract, does not evaluate the merits of any claim, and may be wrong for your situation. Only a licensed attorney who has reviewed your actual documents can tell you whether you have a claim, what it is worth, or what to do. Nothing on the Site should be relied on for any deadline; deadlines are strict and vary by state, and you are responsible for confirming them with an attorney.
We are not a law firm, are not licensed to practice law in any state, do not employ or supervise the attorneys your file may be referred to, and are not a lawyer referral service certified by any state bar. Attorneys who receive referrals are independent, are selected by our intake partner, and are solely responsible for the legal services they provide. See our Attorney Advertising Disclaimer.
3. Who may use the Service
You must be at least 18 years old, located in the United States, and the owner or lessee of the home or the party to the solar agreement you are asking about (or authorized to act for that person). By submitting information about another person, you confirm you have their permission.
4. How the referral works and how we are paid
- You submit the assessment or call us. We may contact you to clarify your answers.
- We send your information to our intake partner, which contacts you, confirms your situation, and decides whether your file is appropriate to refer to an attorney. The intake partner is not a law firm either.
- If your file is referred, an independent attorney or law firm contacts you. Whether to hire that attorney is entirely your decision. Any representation is governed by a separate written engagement agreement between you and the attorney, which will describe the attorney's fees. Some attorneys charge contingency fees, some charge hourly or flat fees, and some cases involve fee-shifting statutes; the attorney will explain what applies to you before you sign anything.
- You pay us nothing. Our intake partner pays us for marketing and intake services, and that payment may depend on the number of consumers we refer. We do not receive any portion of attorney's fees. Our compensation does not depend on the outcome of your matter, and we have no financial interest in the result.
We do not guarantee that your file will be referred, that any attorney will accept your matter, or that any attorney will be available in your state. We may decline or stop any inquiry at our discretion.
5. Consent to be contacted
By submitting a form or asking us to contact you, you agree that CancelMySolar.ai, our intake partner, and any attorney or law firm to which your file is referred may contact you at the number and email you provide by live call, prerecorded or artificial voice message, automated dialing system, text message and email about your inquiry, as described in section 5 of the Privacy Policy. Consent is not a condition of any service. Reply STOP to end texts, or tell us at any time that you do not wish to be contacted.
6. Your responsibilities
- Provide accurate and complete information, and update us if it changes.
- Do not send us Social Security numbers, financial account numbers or government ID numbers.
- Keep paying your solar agreement unless a licensed attorney representing you advises otherwise. Nothing on the Site is a recommendation to stop paying, remove equipment, or breach any agreement.
- Use the Service only for your own legitimate inquiry. Do not scrape, copy, reverse engineer, overload or interfere with the Site, submit false or automated inquiries, or use the Service for any unlawful purpose.
7. Our content
The Site, its text, graphics, logos, the "Solar Position" name and report format, and all software are owned by us or our licensors and protected by copyright and trademark law. You may view and print pages for your personal, non-commercial use. Any other use requires our written permission. Statutes and regulations quoted on the Site are public domain; our summaries of them are not.
8. Third-party services and links
The Service uses third-party providers (for example our form and CRM provider, hosting, telephony, and advertising platforms) and links to third-party websites, including government sources. We are not responsible for their content, accuracy, availability or practices. Your dealings with our intake partner and with any attorney are governed by their own terms.
9. Disclaimers
THE SERVICE, INCLUDING ALL CONTENT, THE ASSESSMENT AND THE CONSULTATION, IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT. LAWS CHANGE AND VARY BY STATE; CONTENT MAY BE OUT OF DATE OR NOT APPLY TO YOU. WE DO NOT WARRANT THAT ANY CONTRACT CAN BE CANCELLED, THAT ANY OUTCOME WILL BE ACHIEVED, OR THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE. RESULTS DESCRIBED ON THE SITE, INCLUDING ANY TESTIMONIALS, DEPEND ON THE FACTS OF EACH CASE AND DO NOT PREDICT YOUR RESULT. Some states do not allow certain warranty disclaimers, so some of the above may not apply to you.
10. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, OLP.COM INC. AND ITS OFFICERS, EMPLOYEES, CONTRACTORS AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF MONEY, PROPERTY, CREDIT STANDING, OR LEGAL RIGHTS, ARISING OUT OF OR RELATED TO THE SERVICE, YOUR RELIANCE ON ANY CONTENT, OR THE ACTS OR OMISSIONS OF OUR INTAKE PARTNER OR ANY ATTORNEY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED ONE HUNDRED DOLLARS ($100). Some states do not allow these limitations, so some may not apply to you; in that case our liability is limited to the smallest amount permitted by law.
11. Indemnification
You agree to defend, indemnify and hold us harmless from claims, losses and expenses (including reasonable attorney's fees) arising from your violation of these Terms, your submission of false information, or your misuse of the Service.
12. Dispute resolution: arbitration agreement and class action waiver
Please read carefully. This section affects your rights.
Informal resolution first. Before starting any formal proceeding, you agree to email help@cancelmysolar.ai with a description of the dispute and to give us 30 days to try to resolve it with you.
Binding arbitration. Any dispute, claim or controversy between you and us arising out of or relating to the Service or these Terms that is not resolved informally will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, before a single arbitrator, rather than in court. The Federal Arbitration Act governs this section. The arbitrator may award the same individual relief a court could. Arbitration fees will be allocated under the AAA consumer rules; if your claim is for $10,000 or less, we will pay all AAA filing, administrative and arbitrator fees beyond the portion equal to a court filing fee, unless the arbitrator finds the claim frivolous. Hearings may be held by video or in the county where you live.
Exceptions. Either party may bring an individual claim in small claims court, and either party may seek an injunction in court to stop unauthorized use of the Service or infringement of intellectual property. This section does not limit your ability to file a complaint with any government agency.
Class action waiver. You and we agree that each may bring claims only in an individual capacity and not as a plaintiff or class member in any purported class, collective or representative proceeding, and that the arbitrator may not consolidate claims of more than one person. If this waiver is found unenforceable as to a particular claim, that claim will proceed in court, not in arbitration, while all other claims remain in arbitration.
30-day opt-out. You may opt out of this arbitration agreement by emailing help@cancelmysolar.ai within 30 days after you first accept these Terms, with your name, phone number and a statement that you opt out of arbitration. Opting out does not affect any other part of these Terms.
13. Governing law and venue
These Terms are governed by the laws of the State of Florida and applicable federal law, without regard to conflict-of-law rules, except that the Federal Arbitration Act governs section 12. Subject to section 12, any court proceeding will be brought in the state or federal courts located in Leon County, Florida, and you consent to their jurisdiction. Nothing in this section deprives you of consumer protections under the law of your state of residence that cannot be waived by contract.
14. Changes and termination
We may change these Terms by posting a revised version with a new effective date; material changes to section 12 will not apply to disputes that arose before the change. We may suspend or end the Service, or your use of it, at any time. Sections 7 and 9 through 13 survive termination.
15. General
These Terms and the Privacy Policy are the entire agreement between you and us about the Service. If any provision is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them to a successor. Notices to us go to help@cancelmysolar.ai or the address above; notices to you go to the email or phone number you provided.
